Contract

By making a booking the client contracts on behalf of himself/herself and all those in his/her party and represents that he/she has the authority to accept the below conditions on behalf of and binding upon all guests in his/her party.

 

Bookings are accepted on the understanding that the property is taken for holiday purposes only and that, excepting babies, the number of people in each property is limited to that entered on the booking form.

 

The client and any friends or family of the client visiting the property while the client is staying there must adhere to the conditions below. If inviting friends to visit the client must first seek the permission of the owners.

 

 

Payment

A deposit of 20% of the cost is payable on booking if the booking is made more than 60 days before the start of the rental, if less than 60 days then the full amount is payable at the time of booking. Bookings are provisional until a deposit is received and are held for 24 hours. The balance shall be payable 60 days before the commencement of the rental. Non-payment of the balance of the rent on or 7 days after the due date may be construed as a cancellation of the contract by the client.

 

Covid-19

Please make sure that your group size adheres with the current government guidelines/laws regarding covid-19. Anyone guests found to be breaking those guidelines or laws will be asked to leave the estate with no refund issued.

Cancellation

If you need to cancel your stay with us please contact us as soon as possible. In the event of a cancellation of less that 60 days before your arrival the total cost is payable. Any cancellation made by the client for whatever reason shall be in writing and addressed to the address on the website. Deposits are non-refundable. The client is strongly advised to take out holiday cancellation insurance.

 

Our rights to cancel and applicable refunds are as follows;

 

We may have to cancel your Booking due to an Event Outside of the Parties Control. We will promptly contact you if this happens.

 

If we have to cancel a Booking, in the first instance we will offer you a postponement of your booking. If that is not suitable, any payments the client has made in advance for Booking that cannot go ahead will be refunded.

 

We may cancel the contract for your Booking at any time with immediate effect by giving you written notice if you:

    • do not pay us when you are supposed to; or
    • break the contract in any other material way

 

Event Outside of the Parties Control

Should any event or circumstance beyond our reasonable control occur which means the Property cannot be provided to you, we will let you know as soon as possible so alternative accommodation at The Lingholm Estate and/or a refund can be arranged for you.

 

In the event of a pandemic, epidemic or restriction of the movement of peoples as dictated by the government or public authority, we reserve the right to issue specific terms at such a time via the Website and will communicate this to you via the contact details provided us.

 

For the avoidance of doubt, self-isolation due to Covid19 and/or showing symptoms of Covid19 is not an Event Outside of the Parties Control.

 

Period of Hire

Rentals for the holiday accommodation commence at 4.30 pm on the day of arrival and terminate at 9.45am on the day of departure.

 

 

Personal Data

You have provided us, directly, through our website or via a third party booking agent, personal data which we will use to fulfil your booking. By placing a booking, via any method, you are explicitly consenting to us using this data to allow the fulfilment of the booking contract including contacting you regarding arrangements relating to the booking prior to or after the rental period.  For full details of how your personal data is used, managed and can be deleted, please refer to our privacy policy

Literature

We have compiled the information in our brochure and on our Website as accurately as possible. However, facilities may be altered or withdrawn for reasons outside our control, in which case we cannot accept responsibility.

We make every effort to ensure that the Property details are accurately reproduced and that the pricing and availability of the Property is correct. Mistakes may occur from time to time, and we reserve the right to rectify errors (including any pricing errors) within 5 business days of you making your booking.

Confirmation should be requested prior to booking if there is any particular detail or facility that is important to you. When you make a booking the Client accepts that minor differences between text/photographs/illustrations in the brochure and on the Website and the actual Property may arise. We cannot accept responsibility should the Property not conform to a Client’s standards.

 

Noise / disturbance

Due to the positioning of the estate and out of consideration for other guests strictly no loud music is to be played after 9pm and no rowdy behaviour inside or outside of the accommodation. Group bookings may not use the houses for parties.

 

 

Right of Entry

Whilst respecting the reasonable privacy of the client, the owners of The Lingholm Estate reserve the right to access all properties at all times, if necessary, for repairs and emergencies.

 

 

Care of the Property

The client shall take all reasonable and proper care of the property and its furniture, pictures, fittings and effects in or on the property and leave them in the same state of repair, condition, cleanliness and tidiness as at the commencement of the rental period.

 

 

Breakages or Damage

The client is required to inform the owner of any damage or breakage in or around the property promptly so that it can be repaired and replaced for the next client.

The client is bound to reimburse the owners for replacement, repair or extra cleaning costs where reasonably demanded by the owners for damage caused by the client. We do not normally charge for minor breakages. We may send you an invoice for repair or making good if the damage or breakage is significant, and we may make an additional charge if you did not report this to us.

 

 

Smoking

Smoking is not permitted anywhere inside the holiday accommodation or near patio / front doors.

 

 

Dogs

A maximum of two dogs are permitted in Derwentwater, Silver Hill, Keepers Cottage, Catbells Cottage, The Lodge and Rosetrees subject to prior arrangement with the owners and the following conditions. Dogs are not permitted upstairs or on the furniture. Dogs must not be left unattended in the property at any time. When out of the cottage the client must clear up after the dog promptly, whether in the garden or out on the estate, and dispose of bagged waste in an exterior dog foul bin. The client is responsible for any damage howsoever caused by their dog and liable to reimburse the owner for any replacement or repair thereby necessitated. Other pets are not permitted.

 

Car charging

There are four EV chargers onsite, Rosetrees and The Lodge have there own for use by the guests staying there only. The other two are shared by the remaining properties and are suitaued in the Main House car park.

The charging car parking spaces are reserved for vehicles which are in the process of charging. Once charged, we request that they be moved to another space which will allow other guests to use the chargers.

Our chargers have a capacity of 7.0kW and cost 0.65per kWh, guests will need to download the app Charge Assist. We suggest you do this and set up an account before you arrive.

No EV charging via the 3 pin plug sockets in the properties is permitted. This invalidates our insurance for safety reasons. We take any breach very seriously, any guests found charging their vehicles in the way will be asked to remove it immediately and will not be allowed to rebook

 

Liability

The owners of The Lingholm Estate are not liable for any loss or damage to any client’s property or any property belonging to a member of the client’s party howsoever caused.

 

The client or members of his/her party cannot hold the owners of The Lingholm Estate liable for any personal injury/death howsoever sustained where the owners and/or their employees have used reasonable skill and care; and/or where caused by the fault of the person(s) affected or any member(s) of their party (including inadequate supervision of children); and/or where caused by the fault of a third party, and/or where caused by an event that could not have been reasonably foreseen or avoided.

 

Lost Property

The owners of The Lingholm Estate are not liable for any of the client’s lost property. Reasonable effort will be made by The Lingholm Estate to inform the client of any lost property items that are found by the housekeeping staff. Lost property will be held by The Lingholm Estate for a period of 1 month, after this time the items will be disposed of. An administration fee of £10 plus postage and packaging will be charged to the client to cover the handling of lost property. The Lingholm Estate does not accept any responsibility for returning items of lost property.
